Welcome to RaceTrace ("the App"), provided by Kotte Consulting AB (559195-0802) ("we", "us"). By using the App, you agree to these terms.

1. What the App Does

The App helps you to collect, visualize, and analyze your GPX data and training information to give you insights into your performance. To function well, the App needs the data you enter or allow the App to collect.

2. Use of the App

You need a compatible device and an internet connection to use the app. You create an account and are responsible for keeping your login details secure and for all activity on your account. The App is offered as a subscription. Specific features and prices depend on the subscription you choose. Information is available at the time of purchase and on the App's Website.

3. Your Training Data (GPX files)

You own your data: All data you enter or collect about your specific training sessions (GPS, times, heart rate, notes, etc.) is yours ("Your Data").

Our right to use Your Data: For the App to function and be improved, you grant us permission (a license) to: (a) process and display Your Data for you in the App; (b) use Your Data in anonymized and aggregated form (so that it cannot be linked to you personally) to analyze trends, improve the App, and develop new features.

Deletion: You can at any time request that Your Data be deleted from your account (see our Privacy Policy). However, we reserve the right to use the data in anonymized/aggregated form.

Your responsibility: You are responsible for ensuring that you have the right to share the data you enter into the App.

4. Our Rights (Ownership of the App)

We (or our licensors) own all rights to the App itself – the code, design, trademark, and all technology. When you have an active subscription, you get a personal right to use the App according to these terms, but you may not copy, modify, sell, or attempt to reverse-engineer the code.

5. Changes

In the App: We are constantly working to improve the App and may therefore add, change, or remove features.

In the Terms: We may need to update these terms. If we make major changes, we will notify you (e.g., via email or in the App) at least 30 days in advance (unless it is due to legal requirements or urgent situations). If you do not agree to the changes, you can stop using the App and cancel your subscription. If you continue to use the App after the changes take effect, you accept the new terms.

6. Ending the Subscription

You can cancel: You can cancel your subscription at any time, usually via your account settings or by contacting our support via the App's Website. The cancellation will be effective from the end of your current billing period.

We can cancel: We can suspend your account or terminate your subscription if you violate these terms. We may also terminate the subscription for other reasons with 30 days' notice (in which case you may receive a refund for any prepaid time you cannot use).

7. Our Responsibility

"As is": The App is provided "as is". We make no guarantees that it will always work flawlessly, be constantly available, or that all data and analysis are 100% accurate. Use is at your own risk.

No health advice: The App does not provide medical advice or professional coaching advice. You are responsible for your own health and for training safely.

Limitation of Liability: We are not responsible for indirect damages (such as lost profits, lost data, or missed training goals). Our total liability for direct damages caused by us is limited to the amount you have paid for the App during the last 12 months, or a maximum of 5,000 SEK, whichever is lower. This limitation does not apply if we have caused damage intentionally or through gross negligence.

8. Privacy and Personal Data

We take your privacy seriously. How we collect and use your personal data is described in our Privacy Policy, which you can find on the App's Website.

9. Other

Contact: You can reach us via the App's Website. We will reach you via your registered email address or via the App.

Force Majeure: We are not responsible for delays or problems caused by events beyond our reasonable control (e.g., natural disasters, war, major technical disruptions).

Law and Dispute: Swedish law applies to these terms. Any disputes shall primarily be resolved in a Swedish public court.
